The Regulatory Imperative for Transparency
Hospital administrators must understand that the black box is no longer acceptable under emerging regulatory standards. The FDA guidance on AI-enabled devices emphasizes the need for continuous oversight and transparency throughout the product lifecycle. Deploying an opaque AI system without mechanisms for auditability and continuous monitoring is a strategic failure that ignores clear regulatory direction.
The question of accountability is what creates the "liability fog": Who is responsible when the system errs? The physician, the vendor, the hospital, or the coder? Until clear accountability structures and robust audit trails are mandated by organizational governance, the ultimate legal and ethical risk rests with the deploying hospital.
